The Association For Smart Regulation LLC will be our members eyes, ears, and unified voice through the Administrative Rule-Making processes utilized to create and amend regulations by the agencies that implement enacted legislation that gives them jurisdiction to regulate our members. We will monitor proposed rule language, inform our membership, identify whether the proposal is SMART, or not and fully engage in the process and advocating in the best interests of members and non-members whom fall within the jurisdiction of the regulation. We will also identify current regulation that is onerous and/ or beyond the statutory authority and we shall advocate for language that diminishes the rule back within the confines of the law. We will engage within the discussion of regulation with the agencies impacting our members, establishing a constructive presence to assist them in ensuring they act for the benefit of our members and the state.
Below, are some of the ways we shall achieve the changes we seek:
- Monitor the state’s rule making process that our public agencies go through to create new rules (Florida Administrative Code, F.A.C.) to implement new statutes, and the rule amendment process for existing rules.
- Keep our members informed of proposed changes to statutes, administrative rules, agency policies and procedural changes and advise them of the potential impact they may have on them.
- When in our membership’s interest, provide public comment, attend public legislative committee meetings, attend regulatory rule-making meetings, licensing board meetings, etc. Maintaining a presence at these events is necessary to remain informed and to have a meaningful impact.
- Leverage the resources of our membership, including financial, experiential, and innovative problem-solving skills to advocate for common sense changes, or in some egregious cases abolishment of the portions of the multilayered web of laws, regulations, agency’ policy and procedures, etc.
